Gerald Chan

Gerald Chan, LLB, is a partner at Stockwoods LLP where he practises public law litigation, with expertise in criminal, constitutional, and regulatory law. He defends clients in white collar and regulatory enforcement matters, including prosecutions of municipal, provincial, and federal offences. He also defends clients charged with traditional criminal offences under the Criminal Code and Controlled Drugs and Substances Act. Gerald frequently acts for clients on appeal and judicial review. He has been counsel in numerous cases in the Supreme Court of Canada, including five cases on digital search and seizure (R v Cole, R v Vu, R v Fearon, R v Marakah, R v Jones), and he is a member of the Ontario Inmate Appeal Duty Counsel Program.

Gerald is recognized as a leading public law practitioner by Best Lawyers in Canada, Benchmark Litigation, and Lexpert. In 2012, he was awarded the Osgoode Alumni Gold Key in the “One-to-Watch” and recognized by Precedent Magazine as a Precedent Setter. He is co-editor of For the Defence, associate editor of the Canadian Rights Reporter, and co-author of Sentencing, 9th ed. (LexisNexis, 2017). He is also an adjunct professor at the University of Toronto, Faculty of Law, where he acts as a field supervisor for the Appellate Criminal Litigation Externship.

Gerald is a member of the Criminal Lawyers’ Association and serves on its Litigation Committee. He is the VP External (Public) of the Federation of Asian Canadian Lawyers. He is also a member of the Judicial Appointments Advisory Committee for the Ontario Court of Justice.

Gerald graduated as the co-Gold Medallist from Osgoode Hall Law School and clerked for the Honourable Justice Rosalie Silberman Abella at the Supreme Court of Canada.
